Sen. Richard Burr (R-N.C.) made a noteworthy declaration about his post-election political intents on Monday, though it was lost amid his joke, for which he has since apologized, about shooting Hillary Clinton.
Should he head back to the Senate, Burr pledged, he would try to block any Supreme Court nomination from a President Clinton.
“If Hillary Clinton becomes president, I am going to do everything I can do to make sure four years from now, we still got an opening on the Supreme Court,” he said.
This is how constitutional crises are made. And it’s also why Sen. Tim Kaine (D-Va.), Clinton’s running mate, told The Huffington Post that Senate Democrats would try to nuke the filibuster option on Supreme Court nominees should they regain power in that chamber.

Maybe Sen. John McCain (R-Ariz.) had the right idea after all. Maybe Republicans are willing to trigger a constitutional crisis over the Supreme Court.
Some conservatives certainly seem to be warming up to McCain’s controversial suggestion last week that Senate Republicans should dig in their heels and block any and all Supreme Court nominees put forth by a future President Hillary Clinton.
Who needs a fully functioning Supreme Court after all?
“As a matter of constitutional law, the Senate is fully within its powers to let the Supreme Court die out, literally,” wrote the Cato Institute’s Ilya Shapiro in a column Wednesday on The Federalist.

The main pretext Republican senators have offered for leaving open the Supreme Court seat of the late Justice Antonin Scalia is that the next president, not Barack Obama, should be the one to fill it.
But now that his party’s nominee, Donald Trump, seems headed for a loss in November, Sen. John McCain (R-Ariz.) appears to be changing his tune ― and may be signaling that more unprecedented obstruction is on the horizon if Hillary Clinton wins the White House.
“I promise you that we will be united against any Supreme Court nominee that Hillary Clinton, if she were president, would put up. I promise you,” McCain said Monday, according to CNN.

It sucks to be Merrick Garland right now. He was nominated to the job of his life — Supreme Court justice — and Republicans won’t even give him a vote. It’s not that they have bad things to say about him; they just don’t want President Barack Obama to fill the empty court seat.
It’s worth noting there are 46 other Merrick Garlands. That is, 46 other judicial nominees are in the same boat. They’re not in line for the Supreme Court, but like Garland, they’re nominees to federal courts who aren’t getting votes (except one, who just got scheduled for a Monday vote). That’s because GOP leaders don’t want to confirm judges until 2017. By then, they hope, a Republican will be in the White House and will put forward nominees they like better.
Not only are they screwing the judicial branch of government by dragging out confirmations — when vacancies pile up on district and circuit courts, people’s cases can get delayed for years and judges burn out — but they’re screwing themselves. Some GOP senators really need judicial nominees confirmed, but are being denied by their own party leaders.

Supreme Court Justice Antonin Scalia, the bench’s ideological conservative known for his fiery comments in and out of the courtroom, has died. He was 79.
Scalia was “a brilliant legal mind with a pugnacious style, incisive wit, and colorful opinions,” President Barack Obama said Saturday night. “He will no doubt be remembered as one of the most consequential judges and thinkers to serve on the Supreme Court.”
Scalia was found dead at a Texas ranch on Saturday morning when he did not appear for breakfast, the U.S. Marshals Service in Washington told The Associated Press.

In what may turn out be a painful blow to labor unions, the Supreme Court will hear oral arguments Monday in a case that could make the entire U.S. public sector a right-to-work zone.
In the case, Friedrichs v. California Teachers Association, a group of public-school teachers in California want the court to rule that the First Amendment prohibits their union from requiring them to pay what are known as “fair-share fees.” Such fees, which all workers in a bargaining unit are obligated to pay, help cover the costs of maintaining union contracts.
If the court rules against the union and workers are given the option of not paying those fees, public-sector unions stand to lose significant funding. The lawsuit, backed by a host of groups on the right, gives conservative justices — especially Justice Samuel Alito — the chance to overturn a four-decade-old precedent that essentially declared fair-share fees to be legal.

The Supreme Court for a number of years has sided with cops in police brutality cases.
The justices did it again Monday, issuing an unsigned summary decision granting immunity to a Texas officer who shot and killed a motorist fleeing police, even though the officer lacked training or even specific orders to open fire.
In so many words, the court ruled the shooting death was legally justified.
The case arose from a civil rights lawsuit against Texas Department of Public Safety trooper Chadrin Mullenix, who wasn’t involved in the chase but had responded to a checkpoint along its route to help intercept a vehicle driven by Israel Leija. Leija was wanted on an arrest warrant, and had fled when police officers tried to serve the warrant at a Sonic restaurant.

The Kentucky county clerk who rose to prominence for refusing to issue marriage licenses to same-sex couples is now headed to jail.
A federal judge on Thursday ordered Rowan County Clerk Kim Davis to be jailed for contempt of court. She has waged a personal war against the Supreme Court’s decision to legalize same-sex marriage.
Davis first defied an order by Kentucky Gov. Steven Beshear (D) for clerks to follow the law. After she was sued in federal court for her noncompliance and ordered to issue marriage licenses, Davis refused again. She sought a delay of that order and lost, so she brought her plea all the way to the Supreme Court, which this week effectively required her to comply.
She has since continued to defy the order, citing “God’s authority.”

The latest and possibly the last serious effort to cripple Obamacare through the courts has just failed.
On Thursday, for the second time in three years, the Supreme Court rejected a major lawsuit against the Affordable Care Act — thereby preserving the largest expansion in health coverage since the creation of Medicare and Medicaid half a century ago.
The stakes of the case, King v. Burwell, were enormous. Had the plaintiffs prevailed, millions of people who depend upon the Affordable Care Act for insurance would have lost financial assistance from the federal government. Without that money, most of them would have had to give up coverage altogether. And the loss of so many customers would have forced insurers to raise premiums, seriously disrupting state insurance markets.

The U.S. Supreme Court was set on Wednesday to hear arguments in a case brought by three death row inmates challenging Oklahoma’s method of execution by lethal injection as a violation of the U.S. Constitution’s ban on cruel and unusual punishment.
The three-drug process used by Oklahoma prison officials has been under scrutiny since the April 2014 botched execution of convicted murderer Clayton Lockett. He could be seen twisting on the gurney after death chamber staff failed to place the intravenous line properly.
Richard Glossip, John Grant and Benjamin Cole, the inmates challenging the state’s procedures, argue the sedative used by Oklahoma, midazolam, cannot achieve the level of unconsciousness required for surgery, making it unsuitable for executions.
