Sen. Richard Burr (R-N.C.) made a noteworthy declaration about his post-election political intents on Monday, though it was lost amid his joke, for which he has since apologized, about shooting Hillary Clinton.
Should he head back to the Senate, Burr pledged, he would try to block any Supreme Court nomination from a President Clinton.
“If Hillary Clinton becomes president, I am going to do everything I can do to make sure four years from now, we still got an opening on the Supreme Court,” he said.
This is how constitutional crises are made. And it’s also why Sen. Tim Kaine (D-Va.), Clinton’s running mate, told The Huffington Post that Senate Democrats would try to nuke the filibuster option on Supreme Court nominees should they regain power in that chamber.

Illinois State Trooper Douglas Balder sat in his squad car, its red and blue lights strobing into the frozen night of Jan. 27, 2014. He was about to be set on fire.
Balder had stopped to assist a Chicago-bound big rig that had stalled out in the rightmost lane of the Ronald Reagan Memorial Tollway. A heavy-duty tow truck and a bright yellow Tollway assistance vehicle were also pulled over, attending to the stranded semi.
Balder, a Navy reservist and father of two, had his heater cranked against minus-30-degree wind chill. He had positioned his 2011 Crown Victoria behind the Tollway vehicle and switched on his flashers. There were also flares sputtering on the pavement, and the Tollway truck was flashing a large blinking arrow and its amber hazard lights. Visibility on that clear, cold night was excellent — around 10 miles.

Gladyes Williamson paced the halls of Congress on Wednesday, armed with a bottle of brown water and clumps of her own hair.
She’d traveled with a group from Flint, Michigan, where high lead levels have made the water irritating to the skin and unsafe to drink since 2014. Williamson trekked 14 hours on a packed bus, with no sleep, to remind Washington of what’s happening in a poor, embattled, industrial town nearly 75 miles north of Detroit.
“Not only do we feel like the Republicans hate us, but now that the Democrats don’t care either,” Williams, 62, told The Huffington Post. “We just need something tangible to make us believe that politicians care about us. The wards in Flint haven’t seen any of this federal aid, but we do all the tax paying and all the dying.”

Pope Francis delivered a speech to U.S. lawmakers on Thursday morning, calling on leaders to consider the plight of the poor and vulnerable in society.
“A political society endures when it seeks, as a vocation, to satisfy common needs by stimulating the growth of all its members, especially those in situations of greater vulnerability or risk,” he said. “Legislative activity is always based on care for the people. To this you have been invited, called and convened by those who elected you.”
His speech touches on issues including climate change, immigration and the refugee crisis, with a shared message of compassion. It was the first time a pope has addressed a joint meeting of Congress.

This week’s slaughter of nine people in a South Carolina church left prospects that Congress will curb guns right where they’ve been for years — remote for now, according to lawmakers and activists on both sides of the issue.
Conceding that congressional action was unlikely soon, President Barack Obama said lawmakers will tighten federal firearms restrictions when they believe the public is demanding it.
“I am not resigned,” Obama told the U.S. Conference of Mayors in San Francisco on Friday. “I have faith we will eventually do the right thing.”

A tentative deal has been reached by senators on a bill to apply congressional oversight to a nuclear deal with Iran.
Under the deal, the president would still be required to submit any final agreement before Congress and Congress would continue to have a say over whether he can lift sanctions on Iran in exchange for restrictions on Iran’s nuclear program. But the new deal, hammered out between Republicans and Democrats on the Senate Foreign Relations Committee, would reduce the time frame the Senate has to consider the lifting of sanctions — from 60 days to 52 at most — and would keep demands on Iran limited primarily to its nuclear program and not, for example, against its sponsorship of terrorism.
An aide to Sen. Bob Corker (R-Tenn.), the chairman of the Foreign Relations Committee, sent over the details of the new bill. It still may face a veto from the president, who has generally opposed efforts to restrict his flexibility when it comes to executing a deal with Iran.

U.S. President Barack Obama assured Americans on Saturday that a newly negotiated framework for a nuclear pact with Iran was a “good deal” as he sought public support for a diplomatic breakthrough that many in Congress oppose.
A day after placing calls to top U.S. lawmakers to urge support for the agreement, Obama pressed his case that the deal would ensure Washington’s longtime foe would not be able to build a nuclear weapon.
“It’s a good deal, a deal that meets our core objectives, including strict limitations on Iran’s program and cutting off every pathway that Iran could take to develop a nuclear weapon,” Obama said in his weekly radio and Internet address, broadcast on Saturday.

President Barack Obama on Wednesday formally asked Congress for new war authority to fight Islamic State militants.
Obama’s request came in the form of a new Authorization for the Use of Military Force. It’s a retroactive request: Congress is receiving the document six months after the U.S. began bombing the Islamic State group, also called ISIS. The president has said he believes he already has the authority to go after the group — citing a sweeping 2001 AUMF as his legal grounds to act unilaterally — but welcomes congressional signoff. Some lawmakers don’t think he currently has the authority.
The proposed AUMF would limit military action against the Islamic State to three years and allow limited use of U.S. ground troops for things like rescue operations or intelligence sharing. It would put no geographic limitations on the military campaign; instead, it would limit military action to countering the Islamic State and associated forces. It would also repeal a 2002 Iraq War AUMF that never expired, but it would leave in place the broad 2001 AUMF. The new AUMF would sunset in three years.

In the first Affordable Care Act case three years ago, the Supreme Court had to decide whether Congress had the power, under the Commerce Clause or some other source of authority, to require individuals to buy health insurance. It was a question that went directly to the structure of American government and the allocation of power within the federal system.
The court very nearly got the answer wrong with an exceedingly narrow reading of Congress’s commerce power. As everyone remembers, Chief Justice John G. Roberts Jr., himself a member of the anti-Commerce Clause five, saved the day by declaring that the penalty for not complying with the individual mandate was actually a tax, properly imposed under Congress’s tax power.
I thought the court was seriously misguided in denying Congress the power under the Commerce Clause to intervene in a sector of the economy that accounts for more than 17 percent of the gross national product. But even I have to concede that the debate over structure has deep roots in the country’s history and a legitimate claim on the Supreme Court’s attention. People will be debating it as long as the flag waves.
