Former President Barack Obama took to Twitter Wednesday morning to encourage people to shop for Affordable Care Act health insurance.

Obama’s rare appeal comes as his signature health care law is under attack by his successor, President Trump, and Republicans in Congress.

Obama’s tweet to his more than 95 million followers includes a short video, set to jaunty music, where the former president urges people to log on to the federal insurance exchange, HealthCare.gov, and sign up for coverage for next year.

“It’s November 1, which means today is the first day to get covered for 2018,” Obama says. It’s not clear where he’s standing, but the ocean is in the background.

On March 23, 2010, President Barack Obama signed the Patient Protection and Affordable Care Act, the 906-page health care reform law known as Obamacare. It was, as a live microphone caught Vice President Joe Biden exclaiming to his boss, a big deal, with Biden memorably inserting an extra word for emphasis—and for history—between “big” and “deal.”

Obamacare would cover millions of the uninsured, a giant step toward the Democratic dream of health care for all. It also included dozens of less prominent provisions to rein in the soaring cost and transform the dysfunctional delivery of American medicine. It was the kind of BFD that the most consequential presidencies are made of, even though it had squeaked through Congress without any Republican votes, and few Americans truly understood what was in it.

Despite last Friday’s shooting at a Planned Parenthood clinic in Colorado Springs, Colorado, women’s reproductive rights faced a new threat Thursday when the U.S. Senate moved forward with its decision to end all of Planned Parenthood’s federal funding.

Though Democrats advocated for retaining the funding, Republicans took the party-line vote at 54-46; the move is part of the Republican Party’s continued attempts to repeal the Affordable Care Act. The White House has stated that President Barack Obama will veto the ruling.

Supreme Court Rejects Obamacare Lawsuit, Preserving Insurance For Millions

The latest and possibly the last serious effort to cripple Obamacare through the courts has just failed.

On Thursday, for the second time in three years, the Supreme Court rejected a major lawsuit against the Affordable Care Act — thereby preserving the largest expansion in health coverage since the creation of Medicare and Medicaid half a century ago.

The stakes of the case, King v. Burwell, were enormous. Had the plaintiffs prevailed, millions of people who depend upon the Affordable Care Act for insurance would have lost financial assistance from the federal government. Without that money, most of them would have had to give up coverage altogether. And the loss of so many customers would have forced insurers to raise premiums, seriously disrupting state insurance markets.

After five years and more than 50 votes in Congress, the Republican campaign to repeal the Affordable Care Act is essentially over.

GOP congressional leaders, unable to roll back the law while President Obama remains in office and unwilling to again threaten a government shutdown to pressure him, are focused on other issues, including trade and tax reform.

Less noted, senior Republican lawmakers have quietly incorporated many of the law’s key protections into their own proposals, including guaranteeing coverage and providing government assistance to help consumers purchase insurance.

A big f***ing deal happened five years ago Monday.

On March 23, 2010, President Barack Obama signed the Affordable Care Act — a law designed to make health insurance available to all Americans and, over time, to make the health care system more efficient. Vice President Joe Biden’s comment that the law was a “B.F.D.,” which an open microphone at the White House ceremony caught, was mainly a reference to the decades-long quest to establish some kind of universal health care system, bringing to the U.S. the same guarantees of financial security and access to medical care that have long existed in every other developed country.

But Biden’s quip was also a statement about the grueling fight to get a bill through Congress. For more than a year, stretching back to Obama’s very first days in office, Republicans and their allies had attacked the law relentlessly and, at times, hyperbolically. They didn’t just doubt that the law would achieve its goals, they also predicted that it would wreak havoc on the federal budget, the economy and the health care system.

Obamacare faces its strangest challenge yet when the Supreme Court takes up the law for the third time Wednesday, but the oddity of the lawsuit shouldn’t obscure the cataclysm that a loss for President Barack Obama would provoke.

The Supreme Court case is the latest legal effort by political opponents of the Affordable Care Act to ruin Obama’s signature domestic achievement. If successful, the suit would tarnish Obama’s legacy, foment infighting among Republicans, aggravate bitter partisanship between the GOP Congress and the White House, and threaten chaos in the health insurance market. But the worst consequences would fall on the estimated 9.6 million people who would lose their health insurance.

The lawsuit, King v. Burwell, isn’t like the previous two Obamacare cases that came before the Supreme Court. Three years ago, in National Federation of Independent Business v. Sebelius, Chief Justice John Roberts joined the court’s four liberals in upholding the constitutionality of the Affordable Care Act’s individual mandate that most Americans obtain health insurance. The Supreme Court last year weakened Obamacare’s birth-control coverage rule in Hobby Lobby v. Burwell, a case with religious-freedom implications.

Obamacare Is Barely Denting Corporate Profits

The biggest entitlement legislation in a generation is causing barely a ripple in corporate America.

The Patient Protection and Affordable Care Act — otherwise known as Obamacare — is putting such a small dent in the profits of U.S. companies that many refer to its impact as “not material” or “not significant,” according to a Bloomberg review of conference-call transcripts and interviews with major U.S. employers.

That’s even after a provision went into effect this year requiring companies with 50 or more full-time workers to provide coverage, and after more workers are choosing to enroll in existing company coverage because of another requirement that all Americans get insured.

New Questions Swirl on an Affordable Care Act Challenger

One of the plaintiffs in the Supreme Court case against the Affordable Care Act listed a short-term-stay motel as her address when she joined the lawsuit, potentially calling into question her basis for suing.

Rose Luck is among four plaintiffs suing the Obama administration to eliminate tax credits under the law that make health insurance cheaper for millions of Americans. They say the wording of the 2010 law allows consumers to tap the credits only in states that run their own insurance exchanges, and not their home state of Virginia, which is one of as many as 37 states that use the federal enrollment system.

The plaintiffs say that, by making their insurance more affordable, the tax credits subject them to the law’s requirement that they carry insurance or pay a fee, which they oppose.

The Supreme Court at Stake

In the first Affordable Care Act case three years ago, the Supreme Court had to decide whether Congress had the power, under the Commerce Clause or some other source of authority, to require individuals to buy health insurance. It was a question that went directly to the structure of American government and the allocation of power within the federal system.

The court very nearly got the answer wrong with an exceedingly narrow reading of Congress’s commerce power. As everyone remembers, Chief Justice John G. Roberts Jr., himself a member of the anti-Commerce Clause five, saved the day by declaring that the penalty for not complying with the individual mandate was actually a tax, properly imposed under Congress’s tax power.

I thought the court was seriously misguided in denying Congress the power under the Commerce Clause to intervene in a sector of the economy that accounts for more than 17 percent of the gross national product. But even I have to concede that the debate over structure has deep roots in the country’s history and a legitimate claim on the Supreme Court’s attention. People will be debating it as long as the flag waves.
